1. Introduction
These Terms of Service ("Terms") govern your access to and use of the services provided by HintCraft Spółka z o.o., a company registered in Poland, with its registered office at ul. Kazimierza Morawskiego 5 /127, 30-102 Kraków, VAT EU: PL6762694168 ("we", "our", or "us").
By using our website, application, or services (collectively, the "Service"), you agree to be bound by these Terms. If you do not agree, please do not use the Service.
2. Eligibility
You must be at least 18 years old to use our Service. By using the Service, you confirm that you meet this requirement and are legally able to enter into this agreement.
3. User Accounts
To access certain features, you may be required to create an account. You agree to:
- Provide accurate, complete, and up-to-date information
- Keep your credentials secure and confidential
- Notify us immediately of any unauthorized access
- Accept responsibility for all activity under your account
We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.
4. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with our Fair Use Policy. You must not:
- Misuse or interfere with the Service or its security features
- Reverse engineer, decompile, or attempt to extract source code
- Use the Service to distribute spam, malware, or illegal content
- Violate any applicable laws or regulations
- Impersonate others or misrepresent your affiliation
- Use automated systems to access the Service without permission
- Attempt to gain unauthorized access to other users' accounts or data
5. User Content and Data
5.1 Your Content
You retain ownership of any content, information, or data you submit to the Service ("User Content"), including profile information, responses, and documents.
By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, process, display, and transmit your User Content solely to provide and improve the Service.
5.2 Your Responsibility
You are solely responsible for the accuracy, legality, and appropriateness of your User Content. You represent and warrant that:
- You own or have the necessary rights to your User Content
- Your User Content does not violate any laws or third-party rights
- Your User Content does not contain malicious code or harmful materials
5.3 Data Retention After Subscription Expiration
When your paid subscription expires and you do not renew, we retain your account data so that you can return without losing your work.
Retention Period:
- We retain your User Content, profile information, and application data for up to 3 years from the date your subscription expires.
- During this period you can sign in to view your data. Premium features are paused until you renew.
- You can request an export of your data at any time by emailing contact@hintcraft.com (see Section 5.4).
Before Data Deletion:
- After the 3-year window we may delete your account and associated data. Where we are able, we will email you in advance.
- If you would like a guaranteed advance notice (for example a 30-day notification before deletion), contact us and we will record the request on your account.
- Renewing for any paid period before deletion resets the retention window.
Early Deletion:
- You may request deletion of your account and data at any time by emailing contact@hintcraft.com.
- We will action verified deletion requests within 30 days.
Exceptions:
- We may retain certain data longer where required by law or for legitimate business purposes (such as resolving disputes, enforcing agreements, or complying with tax/accounting obligations).
- Anonymized, aggregated usage statistics may be retained indefinitely for product improvement.
5.4 Data Export and Account Deletion
You can request an export of your data, or deletion of your account, at any time by emailing contact@hintcraft.com with the subject "Data Export Request" or "Account Deletion Request". Self-service tools for export and deletion are on our product roadmap; until they ship, the email path is the primary route.
6. Privacy and Data Protection
We process personal data in accordance with the General Data Protection Regulation (GDPR) and Polish data protection laws (RODO).

We use Mixpanel Analytics, which respects your privacy and only tracks with your consent. We also use essential cookies (e.g. for authentication, language settings, or payment sessions). See our Cookie Policy for details.
7. Third-Party Services and AI
7.1 Third-Party Integrations
The Service may integrate with or rely on third-party services, including but not limited to AI models, payment processors, and analytics providers. We are not responsible for the availability, accuracy, or performance of these third-party services.
7.2 AI-Generated Content
Our Service uses artificial intelligence (provided by Mistral AI, based in France, European Union) to generate suggestions, recommendations, and content. You acknowledge that:
- AI-generated content is provided as guidance only and may contain errors or inaccuracies
- You are responsible for reviewing and verifying all AI-generated content before use
- We make no guarantees about the accuracy, completeness, or suitability of AI-generated content for your specific situation
- All AI processing occurs within the European Union, ensuring GDPR compliance

8. Professional Advice Disclaimer
IMPORTANT: HintCraft provides tools, templates, and guidance to assist with job searching and interview preparation. However:
- We do not provide professional career counseling, legal advice, employment advice, or psychological services
- We make no guarantees about employment outcomes or interview success
- You are solely responsible for your career decisions and how you use our Service
- The Service is not a substitute for professional advice from qualified career counselors, lawyers, or other professionals

9. Payments and Subscriptions
9.1 Pricing and Billing
Some parts of the Service require payment. Current prices and billing cycles are displayed on our website and within the application. All prices are in the currency specified at purchase and include applicable VAT where required.
9.2 Payment Processing
Payments are processed securely via Stripe. By purchasing a subscription, you authorize us to charge your payment method according to the selected plan.
9.3 Subscription Renewal
Subscriptions do NOT automatically renew. At the end of your subscription period, you must manually purchase a new subscription to continue accessing paid features. You will receive a reminder notification before your subscription expires.
9.4 Refund Policy
Free Credits on Signup:
- New users receive a one-time allocation of free credits on signup so you can try the Service before paying.
- No credit card is required to use the free credits, and no payment is taken until you actively purchase a subscription.
No Refunds After Purchase:
- By purchasing a subscription, you expressly agree to waive your right to the 14-day withdrawal period under EU consumer protection law (Article 16(m) of the Consumer Rights Directive 2011/83/EU)
- This waiver is valid because HintCraft is a digital service that begins immediately upon purchase
- Once you subscribe and begin using the Service, no refunds will be provided for any reason
- No partial refunds are given for unused portions of subscription periods
Service Failures:
- In exceptional cases of significant service failures or technical issues that prevent you from using the Service, we may provide credits or refunds at our sole discretion
- Such cases will be evaluated individually on a case-by-case basis
How to Request: If you believe you are entitled to a refund due to exceptional circumstances, contact us at contact@hintcraft.com with your order details and explanation.
9.5 Price Changes
We reserve the right to change our pricing. Existing subscribers will be notified at least 30 days before any price increase takes effect. Continued use of the Service after the price change constitutes acceptance of the new pricing.
10. Intellectual Property
10.1 Our Property
All content, branding, software, code, designs, trademarks, and other elements of the Service are the property of HintCraft Spółka z o.o. or its licensors and are protected by copyright, trademark, and other intellectual property laws.
10.2 Limited License
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use, subject to these Terms.
10.3 Restrictions
You may not:
- Reproduce, distribute, modify, or create derivative works from any part of the Service
- Remove or alter any copyright, trademark, or proprietary notices
- Use our trademarks, logos, or branding without written permission
11. Service Availability and Modifications
11.1 Availability
We aim to provide reliable, uninterrupted access to the Service but cannot guarantee 100% uptime. The Service may be unavailable due to:
- Scheduled or emergency maintenance
- Technical issues or system failures
- Security concerns
- Force majeure events (see Section 14)
11.2 Service Modifications
We reserve the right to:
- Modify, suspend, or discontinue any feature or functionality
- Update the Service's technical requirements
- Change the Service's appearance or user interface
We will provide reasonable notice of material changes that significantly reduce functionality, except in cases of emergency security updates.
11.3 Impact on Subscriptions
If the Service experiences extended outages exceeding 72 consecutive hours due to our fault, paid subscribers may request a pro-rated credit for the affected period.
12. Termination
12.1 Termination by You
You may close your account at any time by emailing contact@hintcraft.com. Since subscriptions do not auto-renew, there is nothing to cancel mid-cycle: any paid period you have already purchased simply runs to its end. Self-service account closure is on our product roadmap.
12.2 Termination by Us
We reserve the right to suspend or terminate your access immediately if you:
- Violate these Terms or our Fair Use Policy
- Engage in fraudulent or illegal activity
- Pose a security or legal risk to us or other users
- Fail to pay applicable fees
12.3 Effect of Termination
Upon termination:
- Your right to access premium features ends immediately
- Your data will be retained according to our Data Retention Policy (see Section 5.3)
- You can continue to sign in to view your data during the retention period, and you can request an export at any time as described in Section 5.4
- No refunds will be provided for prepaid periods, except as specified in Section 9.4
13. Warranties and Disclaimers
13.1 No Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.
WE SPECIFICALLY DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- ACCURACY, RELIABILITY, OR AVAILABILITY
- ERROR-FREE OR UNINTERRUPTED OPERATION
- RESULTS OR OUTCOMES FROM USING THE SERVICE
13.2 No Guarantee of Results
We do not guarantee that using the Service will result in job offers, interviews, employment, or any specific career outcomes. Your success depends on many factors beyond our control.
14. Limitation of Liability
14.1 Exclusion of Damages
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Service interruptions or data loss
- Damages arising from third-party services or AI-generated content
- Reliance on information provided through the Service
14.2 Liability Cap
Our total aggregate liability for all claims related to the Service shall not exceed the greater of (a) the amount you paid us in the 6 months immediately preceding the event giving rise to the claim, or (b) USD 99 (or its equivalent in the currency in which you were billed, calculated at the European Central Bank reference rate on the date of the claim).
14.3 Exceptions
Nothing in these Terms excludes or limits our liability for:
- Death or personal injury caused by our negligence
- Fraud or fraudulent misrepresentation
- Gross negligence or willful misconduct
- Any liability that cannot be excluded or limited under applicable law
14.4 Consumer Rights
If you are a consumer in the European Union, you have mandatory statutory rights that cannot be excluded or limited by these Terms. Nothing in these Terms affects those rights.
15. Indemnification
To the maximum extent permitted by applicable law, you agree to indemnify, defend, and hold harmless HintCraft Spółka z o.o., its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:
- Your use or misuse of the Service
- Your violation of these Terms
- Your violation of any law or third-party rights
- Your User Content
- Any dispute between you and a third party
This indemnification obligation does not apply to consumers in the European Union/EEA where it is restricted or excluded by mandatory consumer-protection law. For EU/EEA consumers, this Section 15 applies only to the extent allowed under the unfair-terms regime and other applicable consumer law.
16. Force Majeure
We shall not be liable for any failure or delay in performing our obligations under these Terms due to events beyond our reasonable control, including but not limited to:
- Natural disasters, acts of God
- War, terrorism, civil unrest
- Pandemics or public health emergencies
- Government actions or regulations
- Internet or telecommunications failures
- Cyber attacks or security breaches not caused by our negligence
17. Governing Law and Jurisdiction
17.1 Governing Law
These Terms are governed by the laws of Poland and the European Union, without regard to conflict-of-law principles. This choice of law does not deprive a consumer of the protection afforded by the mandatory provisions of the law of the consumer's country of habitual residence (Article 6 of Regulation (EC) No 593/2008, "Rome I").
17.2 Jurisdiction (Business Customers)
For business customers (B2B), any dispute arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts of Kraków, Poland.
17.3 Jurisdiction (Consumers)
If you are a consumer residing in the European Union, your statutory rights under Brussels I bis (Regulation (EU) No 1215/2012) apply: you may bring proceedings against us in the courts of Poland or in the courts of your country of residence, and we may bring proceedings against you only in the courts of your country of residence.
17.4 Alternative Dispute Resolution
Before initiating court proceedings, we encourage you to contact us at contact@hintcraft.com to resolve disputes informally. EU consumers may also use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
18. Changes to Terms
We may update these Terms from time to time to reflect:
- Changes in our Service or business practices
- Legal or regulatory requirements
- Security or technical improvements
18.1 Notification
We will notify you of significant changes by:
- Posting a notice on our website
- Sending an email to your registered address
- Displaying an in-app notification
18.2 Acceptance
Your continued use of the Service after the effective date of updated Terms constitutes acceptance. If you do not agree to the updated Terms, you must stop using the Service and may cancel your account.
Material changes that reduce your rights or increase your obligations will not apply retroactively without your explicit consent.
19. General Provisions
19.1 Entire Agreement
These Terms, together with our Privacy Policy, Cookie Policy, and Fair Use Policy, constitute the entire agreement between you and HintCraft regarding the Service.
19.2 Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.
19.3 Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.
19.4 Assignment
You may not assign or transfer your rights or obligations under these Terms without our written consent. We may assign our rights and obligations without restriction.
19.5 No Third-Party Beneficiaries
These Terms do not create any third-party beneficiary rights.
19.6 Language
These Terms are provided in multiple languages for your convenience. For consumers, the version in the language in which the Service was offered to you (for example, the Polish version for users who accepted these Terms in Polish) prevails in the event of a conflict. For business customers, the English version prevails.
